Health/Mental Health

Our Health/Mental Health Program provides free legal advice and representation to individuals residing in Santa Clara County who identify as having mental health or developmental disabilities and/or who live with HIV or AIDS.

For screening and eligibility, please call the intake line of one of our Health programs, listed below. We have services available in Spanish and Vietnamese and can access interpretation services for other languages. You are also welcome to walk-in during our office hours to speak with our staff.

Among the issues we address are: 

ECONOMIC RIGHTS

  • Public benefits, i.e. denials, overpayments and terminations of SSI/SSDI, Medi-Cal, Medicare, CalWORKs, CalFresh, CAPI, General Assistance, and Veterans' benefits

  • Reasonable accommodations to accessing benefits

  • Name and gender changes

  • Disability discharge of student loans

  • Unemployment Insurance

  • State Disability Insurance

  • Estate planning services

PATIENTS' RIGHTS

  • Represent individuals in inpatient psychiatric facilities at due process and capacity hearings, and educate patients on their rights while in facilities

  • Investigate allegations of abuse or denial of rights at mental health facilities

  • Advocate for access to County Mental Health Services and assist with access to mental health treatment in the County jails


Health Legal Services (HLS)

Through our Health Legal Services program, we offer legal counseling and representation to low-income people living with HIV or AIDS. Specifically, we address issues related to public and private benefits and insurance, housing and consumer matters, simple estate planning, employment discrimination and more.

Our advocates and attorneys operate consistently with our expressed interest philosophy, empowering our clients to make their own decisions about the course of their legal representation.

ELIGIBILITY

Our Mental Health program provides free legal services to any individual who lives in Santa Clara County and who identifies as having a mental health or a developmental disability.  

HLS: Any low-income (500% of federal poverty guidelines or below) resident of Santa Clara County living with HIV or AIDS may be eligible for services.
